Trump’s Tariffs Temporarily Saved by Federal Court

A federal appeals court ruled on Thursday to grant the Trump administration’s petition for a temporary suspension of a prior ruling that had invalidated many of President Donald Trump’s tariffs.

Earlier, the Trump administration informed the U.S. Court of Appeals for the Federal Circuit that it planned to seek “emergency relief” from the Supreme Court if the lower court’s decision was not promptly halted.

The appeals court stated that the judgment made by the U.S. Court of International Trade on Wednesday night is “temporarily stayed until further notice while this court considers the motions papers.”

This pause provides the Trump administration with additional time as it prepares to argue that the law grants the president the authority to unilaterally establish a global tariff system.

A three-judge panel on the trade court, which included one judge appointed by Trump, had previously rejected this assertion, leading to a ruling that nullified all of Trump’s “reciprocal” tariffs and other duties.

The judges concluded that the International Emergency Economic Powers Act, originally enacted in the 1970s, does not bestow “unbounded authority” upon any president to enact such measures.

The nationwide, permanent injunction imposed by the court prohibited all retaliatory tariffs that Trump introduced in early April as part of his broader strategy to redefine international trade relations.

Additionally, the ruling restricted the administration from making any future alterations to the tariffs in question, providing a 10-day window for the administration to implement the court’s orders.

The Trump administration promptly submitted a notice of appeal following the trade court’s judgment.
